• Each bidder must register and qualify with G.A.C. to bid on auction items. The bidder will be recognized by number or online Profile only. Each qualified bidder will be issued a numbered bidder card or Accepted as an online Bidder. Each lot will be identified by lot number. Each sale will be audio/video recorded for General Auction Information and will be used at General Auction’s Discretion.
• The property to be sold is sold in an "as is, where is" condition, with all faults. There are no warranties of any kind, expressed or implied by Seller, auctioneer, MFG, distributors, or employees of General Auction
• No adjustments will be made on any item for any reason whatsoever. All descriptions of vehicles, equipment, tools, parts, machines, general or specific merchandise, are for reference only. The Buyer whether online or on site has the final obligation to determine the size, condition, shape, year, make, model, mileage and value of each item. All sales are final! All Online Bidders are to Have Inspected lots to ensure all information is true and valid as General Auction Co does not take responsibility in any wrong or misprinted information used in any form of Advertisement, Web Flyer, Lot List or any matter discussed.
• A 16% Buyers' Premium will apply on Vehicles & Construction Equipment along with a $20.00 lot fee for Construction Equipment in addition to all other taxes and fees that apply.
• A 18% Buyers' Premium will apply on Miscellaneous & Jewelry along with a $20.00 per lot fee on each lot purchased in addition to all other taxes and fees that apply.
• Here at General Auction Co we strive to be the leader in Customer Service, Please remember Internet pre-auction and live bidding is a service to Bidder. Bidder acknowledges and understands that this service may or may not function correctly the day of the auction. Under no circumstances shall Bidder have any kind of claim against General Auction Co or anyone else if the Internet service fails to work correctly before or during the live auction. General Auction Co will not be responsible for any missed bids from any source. General Auction Co reserves the right to withdraw or re-catalog items in this auction.
* Consignors are not allowed to bid on their own merchandise nor have any agent bid on their behalf. If the Auctioneer recognizes such bidding or is advised of same, the Auctioneer reserves the right to withdraw any or all items consigned by the offending consignor, no exceptions.
• Credit Cards are subject to be authorized for 25% of the credit limit you set during registration, upon approval Bidders are subject to a deposit of $500.00. This may be held during the auction and is fully refundable if nothing is purchased during sale. If Bidder does not follow policy or refuses to pay balance the deposit will be used to pay our Lot Re-Stocking Fee and bidder may be refused acceptance to bid again Online or On site and can also be flagged through Auction World Auctions.
• A twenty-five percent (25%) non-refundable deposit is required on each lot purchased at award of bid. Deposit must be cash, cashier’s check, Credit Card, Wire Transfer. The balance of invoice must be paid by 4:30 p.m. on the following business day. For special payment arrangements please setup method prior to auction day. Delivery of the merchandise can be arranged after receipt of the full purchase price. All state and local sales tax will apply. Resellers must have a valid sellers permit on file with G.A.C. or pay sales tax. If This information is not provided prior to purchase there will be no reversing or changes to invoice. This also includes any Dealer Licenses that are not filed and accepted BEFORE the auction date. Dealer only Lots will be sold only to a valid/licensed dealer, you must have your dealer information submitted before the sale or a restocking fee of $500.00 for lots that are removed from each invoice.
• Proxy Bids. A Proxy may be accepted on items with a value of $2000 dollars or more. A deposit of 25% must be received prior to the auction date. An approval process may be in order if the purchase history does not meet General Auctions Requirements for Proxy Bids.
• General Auction Company will be selling all vehicles as a California Licensed Motor Vehicle Dealer. Each buyer of vehicles will be required to pay all sales tax, D.M.V. fees, and buyer fees. These fees will be paid to General Auction Company. General Auction Company will process all paper work for you at the D.M.V., which includes smog certification. Certain vehicles may be purchased by Licensed Dealer/Dismantler only. Please do not bid on these vehicles if you do not possess a valid Auto Dealer License. Dealers must register prior to bidding on these vehicles.
• Notice to Public: "There is No Cooling-off period unless you obtain a contract cancellation option" California law does not provide for a "cooling-off" or other cancellation period for vehicle lease or purchase contracts. Therefore, you cannot later cancel such a contract simply because you changed your mind, decide the vehicle costs too much, or wish you had acquired a different vehicle. After you sign a motor vehicle purchase or lease contract, it may only be canceled with the agreement of the seller or lessor or for legal cause, such as fraud. However, California law does require a seller to offer a 2-day contract cancellation option on used vehicles with a purchase price of less than $40,000.00, subject to certain statute conditions. This contract cancellation option requirement does not apply to the sale of a motorcycle or an off-highway motor vehicle subject to identification under California law. • All items must be removed within four (4) calendar days of sale. A storage fee of $20.00 will apply on each lot, each day If items are not removed by fourth calendar day after sale. in case of a holiday this schedule will be changed or extended, please contact General Auction for special scheduling during this time. If Transportation of purchased lots is needed please contact General Auction Co for Rates and Schedule.

•Diesel Warning: In accordance with California Code of Regulations Title 13 certain Portable Diesel Equipment and Off-Road Diesel Vehicles may not be legal to operate in California currently or in the future depending on the age of the equipment, application, and other factors and for all off-road diesel vehicles, that “when operated in California, any off-road diesel vehicle may be subject to the California Air Resources Board In-Use Off-road Diesel Vehicle Regulation. It therefore could be subject to retrofit or accelerated turnover requirements to reduce emissions of air pollutants.”
