BY THE ORDER OF THE SELLER, THE FOLLOWING AUCTION PROTOCOL TERMS APPLY FOR THE AUCTION:
BULK BID SESSION:
SESSION #1 - BULK BID ENTIRE BUSINESS: Bidder(s) bid on the entire inventory and business property . Timed internet auction period (see web site). The final bid will be presented to the seller. Seller reserves the right to accept or refuse the final bid. In the event the seller accepts the bid, the auction is concluded. In the event the bid is rejected (temp), auction will proceed to be sold in lots, or piecemeal lots.
Seller reserves the right to accept the bulk bid , at the end of the session. In the event the bulk bid is accepted , the second session will canceled .
INDIVIDUAL LOT SALE:
SESSION #2 - Entire inventory will be offered in lots. Buyers will be bidding on individual items and lots. At the end of session #2, all lots sales will be added, for a grand total sales amount. In the event the amount exceeds Session #1, the inventory will be sold in Session #2. In the event the grand total in Session #2 is less than Session #1, inventory will be sold "bulk " in session #1.
THERE WILL BE NO RE-OFFERS!
Full payment via bank wire, letter of credit, credit card (3% additional buyer's premium) must be paid to auction company by the following business day by 1 PM.
Credit Cards submitted for online bidding approval will be held until replacement payment is received, or submitted for payment.

In the event of non payment by buyer and / or buyer default, buyer will responsible for buyer's premium, any and all legal fees, resale fees, or other fees whatsoever. The lot(s) will be resold, original buyer will assume the liability of any and all loses, or any shortfall of original selling price.

All inventory is sold - FOB SHARON , PA . NO FREE FREIGHT. Buyers can pick up at designated shipping and receiving, by appointment. Seller will stage, palletize, "to the door". Unless buyer is present at shipping, goods will be shipped with a "shippers count".
Buyer(s) agree to hold harmless Loomis Auctioneers of any and all liability whatsoever. To include, but not limited to, product liability, product negligence, product quality, or any related claims, whatsoever.

Buyer(s) agrees that Loomis Auctioneers Inc. and its staff is acting as auction company, only. Buyer(s) agree to hold Loomis Auctioneers Inc. and it staff harmless of any and all liability, whatsoever.
Loomis Auctioneers Inc. agrees to hold all buyer(s) information, bids, communications, business names, financial information, strictly confidential. All information, email communication, written or verbal between buyer(s) and auction company, is held strictly confidential.
Loomis Auctioneers Inc. will not share, or disclose buyer(s) information, bids, or any confidential information, to any other buyer, or third party, whatsoever.

PLEASE NOTE: When a buyer submits a max bid, that bid is confidential, only known by the bidder. The max bid is not known unless another bidder bids, to raise the bid. Even the auction company does not have access to the max bid. For example, if you bid $10.00 on a lot, and the current bid is only $2.00, your max mid will only go to $3.00 as the high bid. (The $10.00 is not revealed, until or if, the bid goes higher). You are also protected in the final seconds, if the competing bidder tries to bid in the last second. The system will protect your max bid, unless the competing bidder would place a higher bid, than the $10.00.
