AN APPROVED BANK CHECK, CERTIFIED CHECK OR CASHIER’S
CHECK, AT TIME OF SALE.
CREDIT CARDS Visa and Master Card will be accepted. A Three Percent
(3%) processing fee will be added to all purchases, however, this fee will be
discounted for purchases paid by cash check or cashiers check.
CARE OF HORSES AFTER SALE Although it is the Griffin Quarter Horses
responsibility to provide care and feed for horses until 5:00 PM the day
following purchase, please be reminded that title passes at the fall of the
hammer, at which time the purchaser assumes all risk and responsibility for
the horse. Purchasers are advised to contact Griffin Quarter Horses to
confirm that proper care is being provided. ALL HORSES MUST BE MOVED
FROM THE SALE PREMISES BY 5:00 PM THE DAY FOLLOWING THE
SALE UNLESS PRIOR ARRANGEMENTS HAVE BEEN MADE WITH
GRIFFIN QUARTER HORSES. Horses remaining after that time are left at
the buyer’s risk and are the buyer’s responsibility. Any delays in shipment of
horses must be approved by Griffin Quarter Horses.

filing a Buyer’s Agent’s Authorization with Triangle Sales Co, Inc, and on the

OF ANY HORSE OFFERED IN THIS SALE. ALL HORSES ARE SOLD
“AS IS” WITH ALL EXISTING CONDITIONS AND DEFECTS.
PROSPECTIVE BIDDERS ARE CAUTIONED that warranties on horses
purchased are only as stated in Terms & Conditions. There is no guarantee
as to performance soundness.
REGISTRATION CERTIFICATE CORRECTIONS It is the responsibility of Griffin
Quarter Horses to ensure that the Registration Papers are Correct. If, after
inspection of the sale animal, if it is discovered that a discrepancy in the
registration papers exists and it therefore becomes necessary to prepare and
submit a Corrected Certificate Form, it will be the responsibility of Griffin Quarter
Horses to do so in a timely manner with no added expense to the buyer.
MULTIPLE EMBRYOS The fact that a foal is an embryo transfer does not
necessarily mean it is one of multiple foals. The fact that a foal was born
naturally out of a mare does not necessarily mean it is a single foal. Neither
Griffin Quarter Horses nor the Triangle Sales Co., Inc. will be held responsible
for providing information as to multiple embryos (foals of the same year) and/or
embryo transfers out of mares or dams in sale; nor will either be held liable in
any way for buyer’s belated awareness of such information.
ANNOUNCEMENTS To avoid costly errors, BUYERS PLEASE PAY
ATTENTION to announcements made from the auction stand. If you are not
sure about an announcement please ask the ring man you are bidding to for
clarification immediately. If you have any questions regarding the horse you
are bidding on, please ask the ring man taking your bid immediately while the
horse is in the sale ring.
DURING THE SALE ANNOUNCEMENTS MAY BE NEW INFORMATION
AND TAKE PRECEDENCE OVER ALL PRINTED MATERIAL.
ENGAGEMENTS Unless announced otherwise, all eligibility payments due
after date of sale are the responsibility of the buyer, who should promptly
notify the proper associations of the new ownership in order to receive direct
billing. The eligibility information supplied by Griffin Quarter Horses is correct.
ACKNOWLEDGEMENT OF PURCHASE After making the final bid on a
horse, you will be asked to complete and sign the Purchase Agreement. Be
sure to CONFIRM THE CORRECT HIP NUMBER AND PRICE before you
sign. This document obligates you to pay the bid amount as shown on the
form. PLEASE PRINT YOUR NAME and address clearly, since this
document is used by the Triangle Sales Co., Inc when preparing the Transfer
Report and by AQHA when mailing you the registration papers. Please use
care when completing this document.
COGGINS TEST All horses in this sale have been tested negative for Equine
Infectious Anemia (Coggins Test) within six (6) months of Sale Date. Test
papers will be included in the buyer’s packet upon settlement.
HEALTH CERTIFICATE A health certificate completed within thirty (30) days
of the sale will be included in the buyer’s packet upon settlement.

Buyer is responsible for knowledge of the online bidding rules and
regulations. A 5% Buyers Premium will be added to the winning bid on
online purchases.
LIVE online bidding will be available during the sale to pre-approved

Description and Title are subject to change based on the parcel
descriptions.
MINERALS: Selling Surface Rights Only.
CLOSING: Closing will take place in 30 days or less at Love County
Abstract and Title Company.
TERMS: Buyers financing must be pre-arranged. Financing is not a
condition of this auction. 25% down day of auction with balance in full
due at closing within 30 days of sale. Property improvements are being
sold as is, where is, in its current condition, with no guarantee written or
implied. A clear marketable title will be provided to buyer or buyers at
closing. 2013 Taxes will be prorated to day of closing. Any announcement
made day of auction takes precedence over any and all
printed material.

FIRST: APPLICABLE LAW: LIMITATIONS OF WARRENTY; VENUE; AND
WAIVER OF JURY TRIAL; The sale and purchase of all horses in this sale and
all matters incidental thereto shall be governed by the laws of the State of
Oklahoma. Venue and jurisdiction for all legal proceedings arising out of the
sale and purchase of any horse sold by Griffin Quarter Horses or out of the
construction interpretation or enforcement of these conditions of the sale and the
rights, remedies and duties of the parties hereto in which Griffin Quarter Horses
or Triangle Sales Co., Inc or the auctioneer (hereafter collectively “GRIFFIN” is a
party shall be solely and exclusively in Love County, Oklahoma. THE
CONSIGNOR, PURCHASER AND GRIFFIN AND THEIR RESPECTIVE
AGENTS, VOLUNTARILY AND INTENTIONALLY WAIVE ANY RIGHT THAT
THEY MAY HAVE TO A TRIAL BY JURY IN RESPECT TO ANY LITIGATION
ARISING FROM OR CONNECTED WITH THIS SALE OR ANY
REPRESENTATIONS, STATEMENTS OR ACTIONS OF THE PARTIES
RELATIVE TO ANY HORSE, HORSES OR CONDUCT. THERE IS NO
WARRANTY EXPRESS OR IMPLIED BY GRIFFIN, OWNER OR
CONSIGNOR, AS TO ANY CONDITIONS OF ANY HORSE INCLUDING BUT
NOT LIMITED TO THE PERFORMANCE SOUNDNESS, MERCHANTABILITY,
OR FITNESS FOR ANY PURPOSE OF ANY HORSE OFFERED IN THIS
SALE. ALL HORSES ARE SOLD “AS IS” WITH ALL EXISTING CONDITIONS
AND DEFECTS. THE PRESENCE OR USE OF THE REPOSITORY SHALL
NOT CHANGE ANY OF THESE CONDITIONS OF SALE, WHICH SHALL
CONTINUE TO BE BINDING UPON ALL PARTIES, NOR DOES IT CREATE
ANY ADDITIONAL EXPRESS OR IMPLIED WARRANTIES.
SECOND - BIDDING PROCEDURE: The highest bidder shall be the buyer.
The successful bidder shall forthwith sign the Acknowledgement of Purchase
should the Acknowledgement of Purchase not be presented to the buyer for
signature prior to the commencement of bidding on the next lot offered, the
buyer shall forthwith identify himself to auctioneer as purchaser and sign the
Acknowledgment of Purchase when presented. The right of purchase of a
successful bidder is not impaired in the case of signing the Acknowledgment
of Purchase by another, provided that such bidder acts in accordance with
THIS CONDITION OF SALE and CONDITIONS OF SALE THIRD below.
The right to bid is reserved for all consignors unless otherwise announced.
THIRD – BIDDING DISPUTES: Should any dispute between two or more
bidders, the auctioneer shall forthwith adjudicate the dispute and his decision
shall be absolute, final and binding on all parties. Bids received after the fall
of the hammer are not grounds for dispute. Bids acknowledged by bid
spotters employed by Triangle Sales Co. Inc. are recognized as if tendered
to the auctioneer, but in case of a dispute the bidding on the horse shall be
forthwith reopened for advance bids, and if there, be no advance, the horse
is sold to the person from whom the auctioneer recognized the last bid. In
the case of such a dispute, advance bidding shall be restricted to the
contending parties, but should the recognized bid be reduced below the bid
of commencement of dispute, then the bidding is reopened to all bidders,
regardless of whether or not the final bid exceeds the bid which was
disputed. The auctioneer reserves the right to reject all bids by persons who
in his judgment are not responsible bidders..
FOURTH – TITLE, RISK, AND DELIVERY: TITLE PASSES TO THE
PURCHASER AT THE FALL OF THE AUCTIONEER’S HAMMER, AND ALL
RISK OF LOSS OR INJURY THEREAFTER SHALL BE THAT OF THE
PURCHASER. Purchaser shall be responsible for the care, custody, control
and security for the horse and for all expenses relating thereto. The
Purchaser agrees to release, defend, indemnify, and hold GRIFFIN and the
owners and/ or owners of the facilities, employees, agents and
representatives harmless from all losses, damages, expenses, claims,
causes of action or attorneys’ fees arising out of injuries or damages caused
by the negligence, active or passive, of GRIFFIN, or any of its employees,
agents or representatives.
Solely, as an accommodation to purchaser, physical possession of each
purchased horse shall be terminated by consignor until purchaser makes
settlement as provided in CONDITION FIFTH below and purchaser requests
physical possession of the horse. WHICH REQUEST SHALL BE MADE NO
LATER THAN EIGHT (8) HOURS AFTER THE FALL OF THE HAMMER.
Delivery of the horse will be by means of a copy of the signed and stamped bid
acknowledgement that will be provided by Triangle Sales Co., Inc. upon
settlement, which release shall be presented to GRIFFIN designee in order to
allow removal of the horse from the sales premises. Upon taking physical
possession, purchaser shall cause horse to be removed promptly from the
sales premises or shall be subject to stable charges as determined by Griffin
Quarter Horses. If for any reason, a horse cannot be taken from the premises
of Griffin Quarter Horses, prior arrangements must be made. GRIFFIN shall
not be liable in any way for any injury or damage to the horse or any third
person as a result of such care, handling or movement of said horse due to its
own negligence, active or passive, or the negligence of third persons.
FIFTH -TERMS FOR SETTLEMENT: Purchaser shall make settlement
immediately upon request by GRIFFIN but in no event later than thirty
minutes after the conclusion of the sales session in which the horse is sold
for the full purchase price. Such settlement shall be in U.S. funds in the form
of U.S. currency, or a bank check, a certified check, cashier’s check, or a
credit card, unless credit has been approved in advance by GRIFFIN. ALL
PAYMENTS SHALL BE MADE TO GRIFFIN QUARTER HORSES. The
failure of GRIFFIN to obtain advance credit approval shall not be a defense
to any claim made by GRIFFIN.
SIXTH – DEFAULT: Any Purchaser who fails to sign an Acknowledgement of
Purchase when required to do so, or fails in any respect whatsoever to make
settlement in accordance with CONDITION FIFTH above, shall be in default.
Any person in default shall immediately become liable to GRIFFIN for the full
amount of the purchase price of all horses purchased, and any costs
incurred by GRIFFIN in the collection thereof, including reasonable attorney’s
fees. Although it shall not be obligated to do so, GRIFFIN shall have the
right to re-sell any horse in default in public or private selected by GRIFFIN in
its sole discretion, including later in the sale without prior notice for the
defaulter’s account. Any amount realized from such sale, after deducting the
costs incurred in the re-sale shall be credited to the defaulter’s account with
the defaulter being liable for any deficiency.
SEVENTH – AUTHORIZED AGENTS: Persons acting as agents must file
notarized letters of authorization from the principal stating the agent is acting
on their behalf and that said principal will be responsible for the agent’s sales
or purchases. These letters must be on file with GRIFFIN Sales Office prior
to the start of the sale. FAILURE TO COMPLY WITH THIS CONDITION OF
SALE WILL IMPOSE PERSONAL LIABILITY UPON SUCH AGENT FOR
PURCHASES OR SALES BY SAID AGENT ON BEHALF OF SAID
PRINCIPAL. PROVIDED HOWEVER, THAT THE FAILURE OF GRIFFIN
TO OBTAIN SUCH WRITTEN AUTHORIZATION SHALL NOT PRECLUDE
GRIFFIN FROM ALSO PROCEEDING AGAINST THE PRINCIPAL.
ENGAGEMENTS, PRODUCE RECORDS AND ALL OTHER INFORMATION
SO LISTED ARE AS REPRESENTED BY GRIFFIN QUARTER HORSES, TO
WHOM ONLY THE PURCHASER SHALL LOOK FOR REDRESS IN CASE
OF ERRORS OR OMISSION. ANY CLAIM REGARDING INACCURACY OF
SUCH INFORMATION NOT OTHERWISE PROVIDED FOR MUST BE
PRESENTED IN WRITING TO GRIFFIN QUARTER HORSES WITHIN
THIRTY (30) DAYS OF THE DATE OF THE SALE AFTER WHICH BUYER
SHALL HAVE NO RIGHT TO MAKE SUCH CLAIMS.
SALE VETERINARIANS (see sale personal) will be available for veterinary
inspection of any animal should you desire their services.
MARKEL INSURANCE COMPANY WILL PROVIDE FREE MORTALITY COVERAGE
FOR 24 HOURS FROM THE FALL OF THE HAMMER ON EVERY HORSE PASSING
