Online Buyer Convenience Fee: An additional online buyers fee of 3% (three percent) of the Final Bid Price will be charged to Online Buyers. This is added to the Buyers Premium of 3% (three percent) of the Final Bid Price charged for all credit card purchases (which is discounted for purchases paid for by cash, check, or bank wire transfer).
Law: The horses are offered for sale according to the laws of the State of Oklahoma.
Bidding Disputes: The highest bidder will be the buyer, and if dispute arises between two or more bidders, the horse in dispute shall immediately be put up again for advance bids. If there be no advance, the horse shall go to the person from whom the auctioneer recognized as the last bid. The auctioneer will decline any bid made by parties who have defaulted in former purchases, or by persons who, in his judgment are not responsible bidders. The right to bid is reserved by all Sellers.
Buyers Payment: Terms of sale are cash (U.S. funds only) to be paid on the day of the sale. Method of payment shall be Cash, Cashier’s Check, Visa or Mastercard, or pre-approved Personalized Bank Check, which has been verified and approved by Western Heritage Sales Co. A 3% fee will be added to the purchase price if payment is made by credit card. All registration papers will be withheld until payments clear the bank. Buyers paying with cash, pre-approved bank check, Mastercard or Visa may pick up papers the day of the sale. All returned checks will be immediately turned over to the Stephens County District Attorney’s office and charges will be filed.
Gate Release: Upon payment by the Buyer to the Sale Cashier, the Cashier will issue an invoice to Buyer which releases the horse from the grounds.
Warranties: With respect to any and all warranties, Western Heritage Sales Co., Oklahoma Horse Fair, auctioneers, and clerks do not represent the Buyer or Consignor but merely provide a medium for bringing together the Buyer and Consignor for the purpose of sale transactions. All responsibilities and guarantees lie solely between Buyer and Consignor. Except as otherwise stated at the time a horse is put up for bids, all horses in catalog will be guaranteed sound for 72 hours by seller.
Title and Risk of Loss: Title to and risk of loss pass from Consignor to Buyer immediately after the horse is struck down by the auctioneer. This shall especially be the condition in the case of illness, injury, or death of any horse after it has been sold. The Buyer agrees to indemnify and hold the Consignor, Western Heritage Sales Co., Oklahoma Horse Fair, harmless from all loss, cost and expense arising from the illness, injury or death of a horse or loss or damage to property and injury or death of persons caused by the Buyer, the Buyers agents or employees or by the horse after the horse has been purchased.
Removal of Horses: All horses must be removed from the auction sale grounds by no later than 4 p.m. on the day following the sale. Failure to remove the horse for any reason will obligate the Buyer to pay all costs associated with board and transportation of the horse.
Caution: Everyone attending this sale agrees to save and hold harmless and indemnify Western Heritage Sales Co., Oklahoma Horse Fair, its agents, employees, and agents thereof, from any and all responsibilities, liabilities, obligations, claims or legal proceedings arising from any accident that may occur to horses, equipment, or for loss by fire, theft, or injury or death to any human or animal in anyway or manner.
Broodmares: Broodmares represented by the Consignor to be in foal are subject to a palpation exam at Buyers request on the mare’s exit from the sale ring. The palpation exam, at Buyer’s expense, must be performed within 24 hours from the time of sale and prior to the mare being removed from the sale premises. Any return privileges or any other agreements, written or otherwise, that exist between the owner of the covering stallion and the consignor will terminate at time of sale and not transfer to Buyer.
Catalog Errors: Every effort has been made to assure correctness of the sale catalog. However, the sale management, auctioneers, and announcers are not responsible for errors or omissions, and assume no liability on its part or on the part of Consignor as to any statement made by the Consignor which are printed in the catalog on behalf of Consignors. When errors or omissions are brought to the attention of the sale management, auctioneers, or announcers, or when such errors or omissions are discovered by the sale management, announcement will be made to correct such errors or omissions. Buyers are cautioned to pay close attention to these announcements made by the auctioneer or announcer at time of sale as these announcements will take precedence over printed matter in the catalog.
Check Liability: The law regarding insufficient fund checks is as follows: Any person signing a personalized check in the State of Oklahoma will be held liable for the amount of the check. No post-dated checks will be accepted. Appropriate legal services will be obtained in whatever state and county necessary in the United States to secure performance of any check given. A $250 fee will be charged on all returned checks.
