MLA is not liable for any third party, or owner representations, valuations or health warranties, whatsoever, of any kind.
This includes veterinarian services.
VET SERVICES: Veterinary and their staff are considered third party vendors to Mercer Livestock Auction Inc. MLA does not guarantee any services, health checks, animal treatment, pregnancy checks, recommendations, quality of service or treatment. This is strictly between the Seller, and Buyers. Buyer's and Sellers agree to “hold harmless” any announcements regarding health, pregnancy or other to MLA and / or auctioneer. It is the buyer’s responsibility to perform any and all due diligence prior to bidding . DO NOT BID if you are not agreeable to these and all MLA auction terms. Auctioneer and /or ring man sells as lot, and claimed by more than one buyer, that lot will be re-offered and sold between the parties.
Buyers, sellers and spectators are not permitted to solicit any business associated with Mercer Livestock Auction or Loomis Auctioneers Inc., whatsoever. This includes, but is not limited to; the buying and selling of livestock, shipment of livestock, dealing of livestock, auctioning of livestock. To include, but not limited to; equipment, farm, real estate or estate, potential auction business that would fall under the category of Loomis Auctioneers. Any direct or indirect solicitation of marketing flyers or verbal solicitation is prohibited.
MLA or it staff is not liable for any livestock or non livestock handling, loading unloading at any time. The buyer is responsible for his lots after he has purchased said lots, and “holds harmless” MLA. MLA acts as a holding and cross dock area.
MLA assumes no liability after the point of sale, exit door of any livestock, or other categories of sale. MLA assumes no liability, or responsibility of any kind to reimbursement to buyer for damage, injury, or death (of livestock). Buyer assumes responsibility of payment without issue, whatsoever, including death of the animal, post sale.
Buyer assumes all liability of purchased livestock at point of purchase. To include, but not limited to, damages caused, injury inflicted on humans, or other livestock.
Buyer assumes any damages or injury to other livestock or humans, of their purchased livestock after the point of purchase(s).
Buyers, sellers and spectators agree to audio, imaging, video recording and internet viewing, in all areas of the faculties.
Any livestock or non livestock held on MLA premises is the sole responsibility of the buyer, seller, or buyer’s agent.
MLA is not responsible for any personal liability to the buyer or seller if the buyer or seller enters the DO NOT ENTER areas of the facility. This includes but is not limited to the yards, pen areas, runway, active cattle tagging and handling areal, shipping and receiving area. MLA is a non smoking facility. Smokers will be asked to leave the premises. All buyers can not self checkout.
Buyers are not permitted to self checkout any livestock or purchases. All checkouts are preformed by MLA staff, only. If yard staff is not available, buyers must wait. In the event buyers are checking out after hours, non auction days, or without staff assistance, buyer or buyer's trucker agrees "hold harmless" Mercer Livestock Auction, staff or shareholder of all liability, shortages, and discrepancies, whatsoever. Buyer can not charge-back, make claims or, any reimbursement from Mercer Livestock Auction, whatsoever.
Bid rigging, bid passing, taking turns bidding, designated bidder, sharing of purchases, invoice manipulation, or any action that directly or indirectly effects, disrupts, or modifies the true or maximum value of a lot by a bidder or buyer, will be subject to the following. Official filing to USDA of said actions. Buyer(s) and Employee's company will hold all liability of the buyer or buyers actions. Buyer agrees to reimburse MLA all financial damage on behalf of the seller in the amount of the short fall, and commissions of the identified lot(s). MLA may also seek additional civil, and criminal claims. Buyer agrees to all financial charge-backs of such claims without, challenge.
In the event of the said alleged violation, buyer, seller or spectator will be subject to but not limited to, USDA penalties, investigation, aggressive and swift civil action, and possible criminal action taken by Mercer Livestock Auction, Inc.
By registering for a buyer’s number or buying with a number or your company name or dealer name, you have agreed to the terms and conditions of the auction and MLA. You also agree to “hold harmless” MLA, is officers, shareholders, staff directly or indirectly of all and any liability, claims, representations of any lots, whatsoever. MLA acts as a selling agent only.
Payment: 100% on sale day, in full. Cash, certified monies, approved company check, credit card (5% added). Checks may require a credit card back up. ALL LOTS SOLD AS IS. In the event of non payment, refusals, bad check, or fraudulent payment of any kind. Buyer agrees MLA can file a confession of judgment and collect all damages. But, not limited to cost of livestock or non livestock. In addition to, but not limited to, court costs, recovery fees, and all legal fees, and lost profits that include commissions, additional marketing and other associated fees. In the event the livestock or non livestock resold, the original buyer is responsible for the all shortfall or losses associated with the second sale, including all fees associated with the sale. Buyer “holds harmless” MLA of all liability, whatsoever.
Buyers, sellers and spectators are not permitted to disrupt the auction, auctioneers, ring men, other buyers or spectators at anytime, whatsoever. Any inappropriate, unprofessional, or unacceptable behavior, whatsoever. In the event a buyer violates this condition, the said buyer will be instructed by management to pay for purchases, and leave the MLA premise at once. Mercer Livestock Auction reserves the right to refuse entry or bidding rights, to anyone.
Registering or participating as a buyer or buyers agent at any MLA auction, you have agreed to the terms and conditions of all MLA auctions. The buyers that are employees of companies, agree personally to these terms, and the companies, buyers, and employers they represent, hold all liability and agree to the terms and conditions of the auction. Buyers buying and signing as buyer, for a third party or company, have full authorization by the said company or other party, to sign terms and conditions, on their behalf. Buyer will also assume full liability, for the terms and conditions of the auction. Company or other party agrees, and acknowledges the said terms and conditions of the auction.

Auction company reserves the right to implement a one time, 15 minute bidding time extension, in the event a bidder attempts to place last minutes, or seconds, bids. Thus, creating unfair "closeout " or counter bid time, to other bidders. This will be know as one time added time of reconsideration, or FINAL LAST CALL, of an additional 15 final minutes. In the event there are no last minute or seconds bid on the original countdown time, bidding will close as advertised. OVERTIME, AND LAST MINUTE BIDDING EXTENSION MAY APPLY (EXTENSIONS BY VARY AUCTION TO AUCTION.) All bidders understand, agree, and consent these terms, and hold Loomis Auctioneers harmless of any liability or claims, whatsoever.
All auction items are sold AS IS, no returns, arbitration, negotiations, or refusals after auctioneer says “SOLD” and you are the successful bidder.

If merchandise is or is not paid for, abandoned by bidder / buyer. The buyer /bidder will be responsible for, but not limited to amount bid, collections, fees, legal fees, labor, and disposal fees. There are no rights of abandonment, whatsoever.
In the event of a NFS check, stop payment check, or any non sufficient or fraudulent non payment of any kind. Buyer irrevocably authorizes any attorney in any court of competent jurisdiction to confess a judgment without process in favor of Loomis Group Auctioneers for such amount as many then appear unpaid herein, and to consent immediate execution upon such judgment. Not only limited to cost of goods, in addition to, but not limited to all fees, commissions, buyer fees, court cost, legal fees, and hourly in house fees by auction company. Buyer “holds harmless” Loomis Auctioneers, and staff of all liability, whatsoever.In the event of NFS check, stop payment check, or any non sufficient or fraudulent non payment of any kind.
