To include issues, that would compromise the fair market value, that include weather conditions, "Act of God", bidding attendance, live location, or online/ internet, lack of interest, or other. This is not an absolute auction. Items sold with seller approval. Most auctions have seller’s approval of acceptance of final bidding.
Reserve Auctions: In any reserve auction, the seller has the right to bid, on any and all items, per auction regulations. The auction company reserves the right to bid on the seller’s behalf, or both.

Auction company reserves the right to implement a one time, 15 minute bidding time extension, in the event a bidder attempts to place last minutes, or seconds, bids. Thus, creating unfair "closeout " or counter bid time, to other bidders. This will be know as one time added time of reconsideration, or FINAL LAST CALL, of an additional 15 final minutes. In the event there are no last minute or seconds bid on the original countdown time, bidding will close as advertised. OVERTIME, AND LAST MINUTE BIDDING EXTENSION MAY APPLY (EXTENSIONS BY VARY AUCTION TO AUCTION.) All bidders understand, agree, and consent these terms, and hold Loomis Auctioneers harmless of any liability or claims, whatsoever.
All auction items are sold AS IS, no returns, arbitration, negotiations, or refusals after auctioneer says “SOLD” and you are the successful bidder.

By registration for a buyer’s number, you agree to “Hold Harmless” Loomis Group Auctioneers, LLC. and it’s staff, directly or indirectly, of any claims, liability, or representation of any lot item, or real estate in the auction.

In the event of non payment, bad check, or fraudulent payment of any kind, buyer agrees for Loomis Auctioneers to file a confession of judgment, and collect all damages. Not only limited to cost of goods, in addition to, but not limited to legal and collections fees, court costs and recovery fee. In the event the said purchases must be resold, the original buyer will responsible for the loss or shortfall, and all expenses associated to the second sale of the goods. Original buyers “holds harmless” Loomis Auctioneers and it staff from any and all liability, whatsoever.

By bidding, each bidder acknowledges and agrees that such bidder has had a full and fair opportunity to inspect the items offered for sale, and is relying solely on the bidder's inspection and investigation. Any merchandise or lots remaining after the auction will be considered abandoned and owner will lose all rights and title to the merchandise, unless agreed arrangements are made with owner or auction company. If merchandise is or is not paid for, abandoned by bidder / buyer. The buyer /bidder will be responsible for, but not limited to amount bid, collections, fees, legal fees, labor, and disposal fees. There are no rights of abandonment, whatsoever.
In the event of a NFS check, stop payment check, or any non sufficient or fraudulent non payment of any kind. Buyer irrevocably authorizes any attorney in any court of competent jurisdiction to confess a judgment without process in favor of Loomis Group Auctioneers for such amount as many then appear unpaid herein, and to consent immediate execution upon such judgment. Not only limited to cost of goods, in addition to, but not limited to all fees, commissions, buyer fees, court cost, legal fees, and hourly in house fees by auction company. Buyer “holds harmless” Loomis Auctioneers, and staff of all liability, whatsoever.In the event of NFS check, stop payment check, or any non sufficient or fraudulent non payment of any kind. Buyer agrees and irrevocably authorizes any attorney in any court of competent jurisdiction and confess judgment without process in favor of Loomis Group Auctioneers for such amount as may then appear unpaid hereon, and to consent immediate execution upon such judgment. Not only limited to cost of goods, in addition to, but not limited to all fees, commissions, buyer fees, court cost, legal fees, and hourly in house fees by auction company. Buyers & Sellers agree to “hold harmless” Loomis Group Auctioneers, LLC staff and offices of any and all liability whatsoever.
