Auction company reserves the right to implement a one time, 15 minute bidding time extension, in the event a bidder attempts to place last minutes, or seconds, bids. Thus, creating unfair "closeout " or counter bid time, to other bidders. This will be know as one time added time of reconsideration, or FINAL LAST CALL, of an additional 15 final minutes. In the event there are no last minute or seconds bid on the original countdown time, bidding will close as advertised. All bidders understand, agree, and consent these terms, and hold Loomis Auctioneers harmless of any liability or claims, whatsoever.
All auction items are sold AS IS, no returns, arbitration, negotiations, or refusals after auctioneer says “SOLD” and you are the successful bidder.
All real estate, and real estate lots are sold AS -IS, without any warranty, or guarantees of any kind, whatsoever. It is solely the bidder’s / buyer’s complete responsibility to perform any, and all due diligence pre auction. Not only limited to cost of goods, in addition to, but not limited to legal and collections fees, court costs and recovery fee. In the event the said purchases must be resold, the original buyer will responsible for the loss or shortfall, and all expenses associated to the second sale of the goods. Any merchandise or lots remaining after the auction will be considered abandoned and owner will lose all rights and title to the merchandise, unless agreed arrangements are made with owner or auction company. If merchandise is or is not paid for, abandoned by bidder / buyer. The buyer /bidder will be responsible for, but not limited to amount bid, collections, fees, legal fees, labor, and disposal fees. There are no rights of abandonment, whatsoever.
In the event of a NFS check, stop payment check, or any non sufficient or fraudulent non payment of any kind. Buyer irrevocably authorizes any attorney in any court of competent jurisdiction to confess a judgment without process in favor of Loomis Group Auctioneers for such amount as many then appear unpaid herein, and to consent immediate execution upon such judgment. Not only limited to cost of goods, in addition to, but not limited to all fees, commissions, buyer fees, court cost, legal fees, and hourly in house fees by auction company. Buyer “holds harmless” Loomis Auctioneers, and staff of all liability, whatsoever.In the event of NFS check, stop payment check, or any non sufficient or fraudulent non payment of any kind.
