Will also consider trade values exceeding the high bid. The seller would pay cash for overage.

To include any act to compromise in a negative way the market or perceived value of any item or lot. Any such act or action will be have swift legal action. Loomis Auctioneers reserve the right to demand all involved parties to leave the auction, and possible action taken.
Any bidders / buyers inappropriate, disruptive, or other behavior, that would compromise the auction results of the auction or any lot(s) will be considered willfulness, with intent. Said bidder / buyer will be subject to any and all possible claims to include; but not limited to, civil action,l ost margins, punitive damages, or other.
After buyer purchases an item or lot, they are completely responsible for that item(s). Auction company or sellers are not responsible for buyer’s items after the buyer purchases the item or lot. Auction staff can not assist in post sale load assistance due to liability issues.

In the event of non payment, bad check, or fraudulent payment of any kind, buyer agrees for Loomis Auctioneers to file a confession of judgment, and collect all damages. Not only limited to cost of goods, in addition to, but not limited to legal and collections fees, court costs and recovery fee. In the event the said purchases must be resold, the original buyer will responsible for the loss or shortfall, and all expenses associated to the second sale of the goods. Original buyers “holds harmless” Loomis Auctioneers and it staff from any and all liability, whatsoever. In the event of non payment, the buyer is responsible, and liable for Loomis Auctioneer's full buyer's premium and commissions included in the claim amount or judgment. In the event the lot is resold, due to nonpayment, and the lot(s) sell for more. The original seller is entitled to all overages. By bidding, each bidder acknowledges and agrees that such bidder has had a full and fair opportunity to inspect the items offered for sale, and is relying solely on the bidder's inspection and investigation. Each bidder further acknowledges and agrees that such bidder is not bidding based on any statements made by the Auctioneer.
Any merchandise or lots remaining after the auction will be considered abandoned and owner will lose all rights and title to the merchandise, unless agreed arrangements are made with owner or auction company. If merchandise is or is not paid for, abandoned by bidder / buyer. The buyer /bidder will be responsible for, but not limited to amount bid, collections, fees, legal fees, labor, and disposal fees. There are no rights of abandonment, whatsoever.
Payment: In the event of NFS check, stop payment check, or any non sufficient or fraudulent non payment of any kind. Buyer agrees and irrevocably authorizes any attorney in any court of competent jurisdiction and confess judgment without process in favor of Loomis Group Auctioneers for such amount as may then appear unpaid hereon, and to consent immediate execution upon such judgment. Not only limited to cost of goods, in addition to, but not limited to all fees, commissions, buyer fees, court cost, legal fees, and hourly in house fees by auction company. Buyer “holds harmless” Loomis Auctioneers, and staff of all liability, whatsoever. In the event of non payment, the buyer is responsible, and liable for Loomis Auctioneer's full buyer's premium and commissions included in the claim amount or judgment. In the event the lot is resold, due to nonpayment, and the lot(s) sell for more. The original seller is entitled to all overages. The defaulted buyer has lost any, and all rights of purchase, or ownership.
Buyers & Sellers agree to “hold harmless” Loomis Group Auctioneers, LLC staff and offices of any and all liability whatsoever.
In the event of any point of purchase rejections of any kind, Loomis Auctioneers and Seller reserve the right to resell the said lot or item. Original buyer will assume all advertising costs, fees, shortfalls
of original selling price paid, and any other fees Loomis Auctioneers may charge, including $200.00 per professional fees associated with the refusal issue. Also includes real estate lots..
Internet Auctions: Auction company reserves the right to implement a one time, 15 minute bidding time extention, in the event a bidder attempts to place last minutes, or seconds, bids. Thus, creating unfair "closeout " or counter bid time, to other bidders. This will be know as one time added time of reconsideration, or FINAL LAST CALL, of an additional 15 final minutes. In the event there are no last minute or seconds bid on the original countdown time, bidding will close as advertised. All bidders understand, agree, and consent these terms, and hold Loomis Auctioneers harmless of any liability or claims, whatsoever. Location Auctions, all lots paid in full on sale day. Such actions would include, but not limited to, bid rigging, bidding collusion, bid arranging, bid passing, agreeing not to bid against another bidder(s) to effect the end price, verbal slander to devalue the lot, or other reasons. Such actions are subject to civil, and other serious claims that are violations of the Pennsylvania Law, that governs such actions at auction. Loomis Auctioneers Inc. will enforce this point of their terms and conditions without hesitation.
