General Terms & Conditions: 10% Buyer’s premium applied to all lots, including real estate. All lots sold as is. Cash, certified money, pre-approved check, credit card (3% added processing fee). All lots paid in full by credit card or credit card back up to pay with in 3 business days of end of auction, without exception. DO NOT BID unless you have the ability to pay, and agree to all terms and conditions.
Bidders and end buyer have read, understand, and agree to the terms and conditions and real estate agreement prior to bidding, and buying. Buyer may not delay for attorney review, post point of sale. All deposits and buyer's premiums must be paid, per agreement.
All lots paid in full by credit card or credit card backup to pay within 2 business days of end of auction, without exception. All real estate deposits and buyers premiums, must be paid in full within 3 business days, with the signed auction real estate agreement. All agreements are published on site, far in advance to the end of auction for review. Buyer may not delay for attorney review, post point of sale. All deposits and buyer's premiums must be paid, per agreement. DO NOT BID unless you have the ability to pay, and agree to all terms and conditions and post auction sales agreements.
Any out of state bidders/buyers must supply valid credit card. In addition, Loomis Auctioneers Inc. may require a driver's license or I.D. to establish authenticity of registration. Loomis Auctioneers Inc. reserves the right to deactivate, blacklist, and pursue legal action, in the event of alleged wrongdoing, bogus, or fraudulent registration information, and/or attempting to bid and buy with false information.
ALL LOTS/ITEMS SOLD AS IS. All descriptions, marketing,representations,and auction lot claims, are provided by seller. Bidders and buyers agree to "hold harmless" Loomis Auctioneers of all marketing claims. Any and all Internet auction items and lots are sold AS-IS. Loomis Auctioneers only provide image, and description of lot. Loomis Auctioneers do not make any claims, warranties, quality, or other claims. It is the buyer's responsibility to attend inspection days, or other, to perform any and all due diligence. Do not bid if you do not agree to these terms. No refunds or adjustments of any kind. In the event of any point of purchase rejections of any kind, Loomis Auctioneers and Seller reserve the right to resell the said lot or item. Original buyer will assume all advertising costs, fees, shortfalls of original selling price paid, and any other fees Loomis Auctioneers may charge, including $200.00 per professional fees associated with the refusal issue. TERMS AND CONDITIONS OF TODAY’S AUCTION
Auction company reserves the right to implement a one time, 15 minute bidding time extension, in the event a bidder attempts to place last minutes, or seconds, bids. Thus, creating unfair "closeout " or counter bid time, to other bidders. This will be know as one time added time of reconsideration, or FINAL LAST CALL, of an additional 15 final minutes. In the event there are no last minute or seconds bid on the original countdown time, bidding will close as advertised. OVERTIME, AND LAST MINUTE BIDDING EXTENSION MAY APPLY (EXTENSIONS BY VARY AUCTION TO AUCTION.) All bidders understand, agree, and consent these terms, and hold Loomis Auctioneers harmless of any liability or claims, whatsoever.
All auction items are sold AS IS, no returns, arbitration, negotiations, or refusals after auctioneer says “SOLD” and you are the successful bidder.
All real estate, and real estate lots are sold AS -IS, without any warranty, or guarantees of any kind, whatsoever. It is solely the bidder’s / buyer’s complete responsibility to perform any, and all due diligence pre auction. All due diligence, to include, but not limited to, structure, land content & acreage, lot sizes, dwelling, building, quality, deed descriptions, boundary and property lines, taxes, wetlands, contamination, any and all items. Sold AS - IS.
Buyer guaranteed a clear, transferable, title by seller. To close within 30 days, or indicated in the terms of sale.

Bid rigging, bid passing, or taking turns bidding, is a crime and illegal. Any violators will be asked to pay and leave the auction and not to attend any future Loomis Group Auctions. In addition, violators will be reported to authorities.
After buyer purchases an item or lot, they are completely responsible for that item(s). Auction company or sellers are not responsible for buyer’s items after the buyer purchases the item or lot.
Auction staff can not assist in post sale load assistance due to liability issues.
Loomis Group Auctioneers is not responsible or can not be held liable for any accidents, should they occur.
By registration for a buyer’s number, you agree to “Hold Harmless” Loomis Group Auctioneers, LLC. and it’s staff, directly or indirectly, of any claims, liability, or representation of any lot item, or real estate in the auction.
All items are sold "AS IS", "WHERE IS" and "WITH ALL FAULTS" without warranty of any kind. Without limiting the generality of the foregoing, there are NO WARRANTIES OF TITLE, NON-INFRINGEMENT, MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE.
Payment Terms: 100% payment on sale days. Cash, certified checks, company checks only with letter of guarantee from bank, credit card, (3% Additional buyer’s premium added to all credit card transactions). All checks require a credit card back up. All items sold AS-IS. Auction company assumes no warranty or liability of any kind, whatsoever. Each buyer is responsible for their items or lots after bought. No reimbursements of any kind. *Real estate payment terms may vary.
In the event of non payment, bad check, or fraudulent payment of any kind, buyer agrees for Loomis Auctioneers to file a confession of judgment, and collect all damages. Not only limited to cost of goods, in addition to, but not limited to legal and collections fees, court costs and recovery fee. In the event the said purchases must be resold, the original buyer will responsible for the loss or shortfall, and all expenses associated to the second sale of the goods. Original buyers “holds harmless” Loomis Auctioneers and it staff from any and all liability, whatsoever.

By registering for a buyer’s number you have agreed to the terms and conditions of this Auction.
Buyer’s Premiums are nonrefundable.
By bidding, each bidder acknowledges and agrees that such bidder has had a full and fair opportunity to inspect the items offered for sale, and is relying solely on the bidder's inspection and investigation. Each bidder further acknowledges and agrees that such bidder is not bidding based on any statements made by the Auctioneer.
Any merchandise or lots remaining after the auction will be considered abandoned and owner will lose all rights and title to the merchandise, unless agreed arrangements are made with owner or auction company. If merchandise is or is not paid for, abandoned by bidder / buyer. The buyer /bidder will be responsible for, but not limited to amount bid, collections, fees, legal fees, labor, and disposal fees. There are no rights of abandonment, whatsoever.
In the event of a NFS check, stop payment check, or any non sufficient or fraudulent non payment of any kind. Buyer irrevocably authorizes any attorney in any court of competent jurisdiction to confess a judgment without process in favor of Loomis Group Auctioneers for such amount as many then appear unpaid herein, and to consent immediate execution upon such judgment. Not only limited to cost of goods, in addition to, but not limited to all fees, commissions, buyer fees, court cost, legal fees, and hourly in house fees by auction company. Buyer “holds harmless” Loomis Auctioneers, and staff of all liability, whatsoever.In the event of NFS check, stop payment check, or any non sufficient or fraudulent non payment of any kind. Buyer agrees and irrevocably authorizes any attorney in any court of competent jurisdiction and confess judgment without process in favor of Loomis Group Auctioneers for such amount as may then appear unpaid hereon, and to consent immediate execution upon such judgment. Not only limited to cost of goods, in addition to, but not limited to all fees, commissions, buyer fees, court cost, legal fees, and hourly in house fees by auction company. Buyer “holds harmless” Loomis Auctioneers, and staff of all liability, whatsoever.
Buyers & Sellers agree to “hold harmless” Loomis Group Auctioneers, LLC staff and offices of any and all liability whatsoever.
Auctioneer(s) reserves the right to instruct the bidding increments, and set minimum bidding increments, prior to or during the bidding. Auctioneer(s) reserves the right to reject any or all bids, at their discretion.
ALL LOTS SOLD AS IS. NO REFUNDS, NO RENEGOTIATION, NO ARBITRATION, NO RETURNS, WHATSOEVER. All internet auction buys and transactions must be paid by credit card, or other pre approved payment methods within 2 business days of conclusion of auction. Any extended days without approval will be considered violation or breach terms & conditions. Loomis Auctioneers reserves the right to enforce the terms and conditions.
Loomis Auctioneers Inc. reserves the right to, but not limited to, refuse, reject, strike, cancel, deny, any bidding, any registration, attempting to bid, buy, register, or other, for any reason, whatsoever. Loomis Auctioneers Inc. reserves the right to "Black List" any registered bidder for any reason, without liability, whatsoever.
