An automatically renewable 1 year lease covering the following described premises situated in Haskell County, State of Oklahoma:
That tract of land located in the East one-half of the Northwest one-quarter (E/2NW) of Section 24 Township 9 North Range 18 East lying North of Oklahoma State Highway No. 9 in Haskell County, Oklahoma, containing 60 acres, more or less. The Lessor is Haskell County, Oklahoma.
The above described leased premises to be used by the Lessee for the sole purpose of mining, extracting, removing, and taking from said premises all of the merchantable and marketable rock and gravel owned in and under said premises, with the right to remove any and all top soil or “overburden” above said rock and gravel, and also Lessee shall have the right to use necessary space for construction and placement of, and buildings or fixtures necessary to the performances of the business of removing and selling said rock and gravel, including, but not limited to the production of asphalt. Annual rental is $72,000, with an additional obligation to furnish Lessor with rock and/or related materials valued at $6,000 per month. Annual rental is paid through Aug. 1, 2008. The Lessor is Haskell County, Oklahoma.
Assignment of the lease is subject to Lessor approval, or the holding company (Haskell Rock Holding Company, LLC, an Oklahoma limited liability company) holding the Lessee's interest under the lease can be transferred to the buyer, at the buyer's election.
