TERMS OF SALE
1.Terms of Sale: The price that you pay is the amount accepted by Luxur Auction, plus a buyer's premium (a percentage of the final price) and tax where applicable. You will be given an invoice made out to the name and address on your Registration Form, which may not be subsequently altered. The invoice gives a breakdown of the various costs. Full details of charges and rates can be found in the 'Conditions of Sale' and 'Important Notices' printed in each catalogue.
2.Terms of payment are:
•Cash. Payments can be made at Luxur Fine Cars Office, either during or after an auction.
•Debit Card. There is no additional charge for purchases made with these cards.
•Credit Card. Visa – Mastercard – Amex cards are accepted. It is often a good idea to let your card provider know in advance that you intend to buy something. This can help cut down the time we need to seek authority when you come to pay. Credit card payments require photo ID to be provided. A 3% service charge on the total credit card purchases processed.
•Bank draft. This will need to be confirmed with the issuing bank, prior to acceptance
•Certified cheque. (Personal cheques and/or business cheques are not be accepted)
•Wire transfers. All transfers must state the relevant auction number, lot number and your bid number. If transferring from a foreign currency, the amount we receive must be the total due after currency conversion into Canadian Dollar and the deduction of any bank charges.
A sale is final only upon receipt of the buyer’s full payment
3.Financing. Up to 100% financing with $0 down. Affordable, low payments.
•Flexible Open and Closed lease options with potential tax benefits.
•Get pre-approved before you bid. Luxur Auction offer buyers an option for pre-approval for auto loan financing and Auto Leasing prior to bidding online.
•All other arrangements must be approved by senior management.
4.Buyer Verification: The Buyer must verify the following: Before bidding on a vehicle - the accuracy of any information obtained from websites, catalogs, handouts, (such as km’s, years, make, model, etc.). Buyer can view all the detailed information on the vehicle being purchased located on our website: www.luxurfinecars.ca. All statements by Luxur Auction and those statements printed in advertisements are believed to be correct.
5.Warranty: buyer will be notified if any applicable balance of the original manufacturers factory warranty that it still in effect and it is transferable to the new buyer. In no event shall the auction be responsible for any other guarantees. Luxur auctions may offer extended warranties on qualifying vehicles at an additional cost.
6.All vehicles are offered for sale subject to reserve price set by the seller unless otherwise stated.
7.To Register: All bidders must submit the bidder agreement form online with the required items listed on the bottom page below in order to bid.
8.Ownership of the vehicle passes to the bidder when the bid has been accepted by the seller and posted as “SOLD”.
9.Should any dispute in a bid arise, Luxur Auction will reserve judgement and the decision is final.
10.The highest bids will be defined as a pending sale in which a high bid was recorded at the auction block but was subject to the seller’s acceptance at a later time. The seller is under no obligation to accept the highest bid if it does not meet the reserve price.
11.A purchaser’s failure to comply with all of the conditions of sale entitles Luxur Auction and the consignor to use other available remedies or courses of legal action to hold the purchaser liable. This may include the following: a. Cancel the sale and retain as liquid damages all payments made by the purchaser. b. Re-sell the vehicle to a new purchaser at a private or public sale and in any such event the purchaser shall be liable for deficiency plus any incurred legal fees or court costs.
12.Delayed Payment Agreement:
a. Buyer agrees to pay in full with cash or certified cheque, or any other pre-arranged and Luxur auction approved form of payment in the full amount owed on any vehicle for which the buyer signs a contract.
b. Buyer understands that the entire amount of any purchase I make must be paid by 6:00 PM on the FIRST banking day following the auction day.
c. Buyer understands that failure to pay for the vehicle on time will entitle Luxur auction or the consignor to hold the purchaser liable. This may include all legal fees and/or court costs.
13.Shipping & pick-up Details: Vehicles must be paid for in full before they will be released to the buyer for pick-up or shipping. All vehicle Shipping and insurance are 100% the responsibility of the buyer. If you require open or enclosed transportation anywhere in Canada / USA or anywhere else in the world on the vehicle that you purchased from us, we will arrange it for you through one of our highly recommended and bonded transportation companies.
14.BUYER’S FEE OF 7% of the bid amount will be charged to the Purchaser of each vehicle auction lot that it is sold. MINIMUM SALES COMMISSION ON VEHICLES IS $600.00.
15.SELLER’S FEE OF 10% of the total bid amount will be charged to the Seller of each vehicle auction lot that it is sold.
16.GST: All vehicles purchased, and the bidder’s commission fee will be subjected to applicable GST.
17.All vehicles purchased will be subject to Provincial Sales Tax where applicable (applies when auctions are held outside Alberta).
18.After the Auction: Online results, if you weren't present or able to follow the auction live, you can find details online via the Luxur Auction website in the 'Auction Results' section, so that you can easily check whether or not you were successful, If you would like to know the outcome on the day, you are welcome to call us one day after the end of the auction at 780-540-5400.
19.NO BIDS WILL BE ALLOWED AND OR TAKEN FROM UNREGISTERED BIDDERS.
